1. Agreement to Terms

By accessing or using Get DMV Appointments ("the Service"), operated at getdmvapt.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. We reserve the right to update these Terms at any time, and continued use after changes constitutes acceptance.

2. Service Description

Get DMV Appointments is an independent, private service that monitors the publicly available Texas Department of Public Safety (DPS) scheduling system on your behalf. When an appointment slot matching your preferences becomes available, we attempt to book it for you automatically.

The Service does not guarantee that an appointment will be found or successfully booked. Appointment availability depends entirely on the Texas DPS scheduling system, which is outside our control.

3. Service Fee Disclaimer

The fee charged by Get DMV Appointments is a service fee for automated appointment search and booking assistance. This fee is paid to Get DMV Appointments, a private business, and not to any government agency.

The Texas Department of Public Safety (DPS) does not charge any fee for scheduling appointments. You always have the option to book an appointment directly through the official DPS website at public.txdpsscheduler.com at no cost.

Our service fee covers the operation and maintenance of our automated monitoring systems, which check the DPS scheduling system on your behalf around the clock and attempt to book an appointment when a matching slot becomes available.

We use legally permitted methods to access publicly available scheduling information. We do not hold, reserve, block, or manipulate appointment availability in any way. Appointment availability is solely determined and controlled by the Texas DPS.

4. Eligibility

To use the Service, you must:

Be at least 18 years of age, or have a parent or legal guardian agree to these Terms on your behalf.
Provide valid, accurate personal information required by the Texas DPS scheduling system.
Have a legitimate need for a Texas DPS appointment (e.g., driver license, ID card, or permit).

5. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@getdmvapt.com if you suspect unauthorized use of your account.

6. Payment Terms

The Service charges a one-time fee of $29.99 per appointment search. Payment is processed securely through Stripe. By submitting payment, you authorize us to charge the provided payment method.

All prices are listed in US dollars. You are responsible for any applicable taxes.

7. Refund Policy

We offer a no-risk refund policy. If we are unable to book an appointment within 7 days of your search activation, you receive a full, automatic refund. You may also cancel your search at any time for a full refund, provided an appointment has not yet been booked. For complete details, please see our Refund Policy.

8. Service Limitations

You acknowledge and agree that:

The Service does not guarantee appointment availability. Slots are controlled entirely by Texas DPS and may be limited.
We are a search assistance service, not a government service. We are not affiliated with, endorsed by, or connected to the Texas Department of Public Safety or any government agency.
Results depend on DPS appointment availability, which we do not control. Appointment availability, scheduling system uptime, and booking success are subject to factors beyond our control.
The Service may experience interruptions due to maintenance, updates, or unforeseen technical issues.
You can always book appointments directly through the official DPS website at no cost. Our service is an optional convenience tool.

9. User Acknowledgments

By creating an account and using our Service, you acknowledge and confirm that:

You understand that the fee you pay is a service fee paid to Get DMV Appointments, a private business, and not a fee paid to any government agency.
You understand that the Texas DPS does not charge any fee for scheduling appointments.
You understand that you can book an appointment directly with the Texas DPS at no cost through the official DPS website.
You understand that appointment availability is controlled entirely by the Texas DPS and that we do not guarantee any specific outcome.
You understand that Get DMV Appointments is not affiliated with any government agency and that Get DMV Appointments and the Texas DPS are completely independent entities.

10. User Obligations

When using the Service, you agree to:

Provide accurate and truthful personal information. Inaccurate information may result in failed bookings.
Maintain only one active search at a time per account.
Use the Service only for its intended purpose of booking legitimate DPS appointments.
Not attempt to reverse-engineer, exploit, or misuse the Service in any way.
Not use the Service to resell, scalp, or hoard appointment slots.

11. Intellectual Property

All content, branding, design, code, and functionality of the Service are owned by Get DMV Appointments and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without prior written consent.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY APPOINTMENT WILL BE SUCCESSFULLY BOOKED.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GET DMV APPOINTMENTS AND ITS OPERATORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE (I.E., $29.99).

14. Indemnification

You agree to indemnify, defend, and hold harmless Get DMV Appointments, its operators, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of the State of Texas.
